AN ORDINANCE TO ESTABLISH A PARKING VIOLATIONS
BUREAU TO ACCEPT THE PAYMENT OF FINES AND COSTS
FOR PARKING VIOLATIONS AS DEFINED IN THIS ORDINANCE
ORDINANCE NO. 43-B
At a regular meeting of the Township Board held in the Township
Hall on the 10 day of August, 1992, at 7:30 p.m., the following
Ordinance was heard and passed:
THE
TOWNSHIP OF SPRING ARBOR ORDAINS:
SECTION 1. ESTABLISHMENT OF PARKING VIOLATIONS BUREAU
There is hereby established a Parking Violations Bureau to accept
fines and costs as prescribed by this Ordinance for the parking
or standing of a motor vehicle in violation of this Ordinance. The
Parking Violations Bureau shall be located in the Township of Spring
Arbor Hall at 107 Teft, Spring Arbor, Michigan, and shall be open
during regular business hours of the Township.
SECTION 2. PROHIBITED PARKING
2.1 A vehicle shall not be parked, except if necessary to avoid
conflict with other traffic or in compliance with the law or the
directions of a police officer or traffic-control device, in any
of the following places:
a. On a sidewalk.
b. In front of a public or private driveway,
c. Within an intersection.
d. Within fifteen (15) feet of a fire hydrant,
e. On a crosswalk.
f. Within twenty (20) feet of a crosswalk, or if there is not
a crosswalk, then within fifteen (15) feet of the intersection
of property lines at an intersection of highways.
g. Between a safety zone and the adjacent curb or within thirty
(30) feet of a point on the curb immediately opposite the end
of a safety zone, unless a different length is indicated by an
official sign or marking.
h. Within twenty (20) feet of the driveway entrance to a fire
station and on the side of a street opposite the entrance to a
fire station within seventy-five (75) feet of the entrance if
properly marked by an official sign.
i. Alongside or opposite a street excavation or obstruction, if
the stopping, standing, or parking would obstruct traffic.
j. On the roadway side of a vehicle stopped or parked at the edge
or curb of a street.
k. At a place where an official sign prohibits stopping or parking.
1. In a place or in a manner which blocks or hampers the immediate
use of an immediate egress from a fire escape»conspicuously
marked as a fire escape providing an emergency means of egress
from a building.
m. In a parking space clearly identified by an official sign as
being reserved for use by handicappers which is on public property
or private property available for public use, unless the person
is a handicapper as described in Section 19A of the Michigan Motor
Vehicle Code or unless the person is parking the vehicle for the
benefit of a handicapper. • A certificate of identification
issued under Section 675 (5) of the Michigan Motor Vehicle Code
to a handicapper shall be displayed on the lower left corner of
the front windshield or a special registration plate issued under
Section 803 (d) of the Michigan Motor Vehicle Code to a handicapper
shall be displayed on the vehicle.
n. In violation of an official sign restricting the period of
time for or manner of parking.
2.2 A person shall not move a vehicle not owned by the person into
a prohibited area or away from a curb a distance which makes the
parking unlawful.
SECTION 3. PRIMA FACIE RESPONSIBILITY FOR PARKING VIOLATION
3.1 If a vehicle is stopped, standing, or parked in violation of
this Ordinance the person in whose name the vehicle is registered
in this State or another State at the time of the violation is prima
facie responsible for that violation and subject to the fines and
costs hereunder.
3.2 The owner of the vehicle cited for a stopping, standing or parking
violation pursuant to this Ordinance may assert as an affirmative
defense that the vehicle in question, at the time of the violation,
was in the possession of a person whom the owner had
not knowingly permitted to operate the vehicle.
SECTION 4. ISSUANCE OF PARKING CITATIONS. FINES AND COSTS
4.1 Parking violation notices may be issued by a police officer,
ordinance enforcement personnel, or such other personnel duly authorized
by the Township of Spring Arbor to issue such a
notice under this Ordinance. Limited duty personnel shall be appointed
by the Township Board, and a list of such personnel shall be kept
on file at the Parking Violations Bureau and the 12th District Court
for the County of Jackson.
4.2 A parking violation notice may be served by attaching a copy
of the notice to the vehicle.
4.3 The fines and costs for the parking violations set forth in
this Ordinance shall be as established by Resolution of the Township
Board from time to time, and as set forth in Appendix A of this
Ordinance which is hereby declared to be a part of this Ordinance.
4.4 The fines and costs imposed by this Ordinance shall be in addition
to any other remedies available to the Township and shall not prescribe
the Township or its officers from issuing citations under the Uniform
Traffic Code adopted by the Township.
SECTION 5. EFFECTIVE DATE
This Ordinance shall be published in the manner provided by law
and shall take effect and be in force from and after the earliest
date allowed by law. Said Ordinance shall become effective upon
publication.
