TOWNSHIP OF SPRING ARBOR
AN ORDINANCE TO REGULATE THE DISCHARGE OF LETHAL WEAPONS WITHIN THE TOWNSHIP
ORDINANCE NO. 42-B


At a regular meeting of the Township of Spring Arbor Board
held on the 8th day of July, 1991 at 7:30 o'clock p.m.,
Eastern Standard Time, the following Ordinance was heard and passed:

THE TOWNSHIP OF SPRING ARBOR ORDAINS:


SECTION 1. TITLE
This Ordinance shall be known as the "Lethal Weapon Ordinance" for the Township of Spring Arbor.


SECTION 2. PURPOSE
It is the purpose of this Ordinance to safeguard the health,
safety and welfare of the residents of Spring Arbor by regulating the discharge of certain weapons in residential areas. It isdetermined by the Township Board that such regulation is necessary to preserve the peace and to reduce injuries and fatalities.


SECTION 3. PROHIBITED ACTS
It shall be unlawful for any person to discharge or allow another to discharge any firearm of a caliber exceeding .17 caliber in a residentially zoned area, or within 450 feet of any dwelling or structure in the Township of Spring Arbor, or to discharge any arrow or missile from a bow exceeding ten (10) pounds of pull in any residentially zoned area, or within 450 feet of any dwelling or structure in the Township of Spring Arbor.


SECTION 4. DEFINITION
A residential area is defined as any lot, parcel or land zoned residential under the Zoning Ordinance and Zoning Map for the Township of Spring Arbor.


SECTION 5. ENFORCEMENT
This Ordinance may be enforced by the Township Supervisor, Township Police Chief, police officers, or building inspector.


SECTION 6. PENALTY
Any person who violates any provision of this Ordinance shall, upon conviction thereof, be deemed guilty of a misdemeanor and may be fined not more than Five Hundred ($500.00) Dollars and costs of prosecution, or imprisoned in the County Jail not to exceed ninety (90) days or by both fine and imprisonment.


SECTION 7. SEVERABILITY CLAUSE
This Ordinance is hereby declared to be severable and should any part, provision or paragraph hereof be declared invalid by a Court of competent jurisdiction, it shall not affect the remaining provisions hereof.


SECTION 8. EFFECTIVE DATE
This Ordinance shall become effective thirty (30) days after publication in a newspaper of general circulation.
