AN ORDINANCE TO REQUIRE THE REGISTRATION
OF BUSINESSES HAVING HAZARDOUS
MATERIAL ON THE PREMISES
ORDINANCE NO. 4l-B
At a regular meeting of the Township of Spring Arbor Board
held on the 10th day of June, 1991, at 7:30 p.m., Eastern
Daylight Time, the following Ordinance was heard and passed:
THE TOWNSHIP OF SPRING ARBOR ORDAINS:
SECTION 1. REGISTRATION REQUIREMENT
Any business located in the Township of Spring Arbor which is required
by State or Federal law or Statute to supply the Township of Spring
Arbor Fire Department with material safety data sheets and a hazardous
material response plan for either on-site or off-site material shall
register said business with the Clerk of the Township.
SECTION 2. REGISTRATION CONTENTS
Any business required by this Ordinance to register with the Township
shall provide the following information to the Township Clerk:
a. The name of the business.
b. The address of the business.
c. The owner of the business.
d. The type of the business.
e. A copy of the hazardous material response plan and material safety
data sheets together with any changes in such plan or sheets.
SECTION 3. PENALTY
Any business which fails to register as required to do so by this
Ordinance shall be guilty of a misdemeanor and upon conviction thereof
shall be punished by a fine of not to exceed Five Hundred ($500.00)
Dollars or imprisonment in the County Jail of Jackson County, Michigan
for a period of not more than ninety (90) days, or both such fine
and imprisonment.
SECTION 4. EFFECTIVE DATE
This Ordinance shall take effect and be enforced from and after
the earliest date allowed by law. This Ordinance shall be published
in the manner provided by law.
