TOWNSHIP OF SPRING ARBOR
AN ORDINANCE TO REGULATE THE ISSUANCE OF LIQUOR LICENSES AND TO ESTABLISH CRITERIA FOR INITIATION OF PROCEEDINGS TO RECOMMEND REVOCATION OR NON-RENEWAL OF A LIQUOR LICENSE, AND CRITERIA FOR SUCH RECOMMENDATION OF REVOCATION OR NON-RENEWAL

At a regular meeting of the Township Board, held in the Town-ship Hall on January 10, 1983 , the following Ordinance was heard and passed:
THE TOWNSHIP OF SPRING ARBOR ORDAINS:

WHEREAS, a liquor license is a property right in the State of Michigan; and
WHEREAS, it is necessary to establish criteria for the issuance, revocation or non-renewal of licenses. IT IS HEREBY ORDAINED by the Township of Spring Arbor that the following criteria are hereby established for the issuance or recommendation of revocation or non-renewal of a liquor license in the Township of Spring Arbor:


1. Each licensed establishment shall be located in an area and on a parcel zoned for such use, and shall meet all zoning re-quirements of the Township of Spring Arbor, County of Jackson, State of Michigan.


2. The premises of the business to be licensed shall have a seating capacity of not less than one hundred (100) persons, which capacity shall be determined in accordance with applicable state statutes and local ordinances.


3. The establishment shall be equipped to and will serve full-course meals, including, but not limited to dinners.


4. At least 50% of the gross income of the licensed estab-lishment shall be received from non-spirit sales.


5. The Licensee's building and other structures must meet all local health codes, building codes, plumbing codes, electrical codes, and mechanical codes, together with all applicable State and Federal Codes relevant thereto.


6. No establishment shall be operated in such a fashion as to create a public nuisance.


7. Any establishment or Licensee violating the rules of the Michigan Liquor Control Commission shall be subject to a hearing for the purpose of determining whether to recommend revocation or non-renewal of its license.


In the event that the Township desires to conduct a hearing to consider the issuance, revocation, or non-renewal of a license under this Ordinance, the holder of the license shall be given a notice of hearing, the reasons given for the hearing, an opportunity to be present together with an attorney and such wit-nesses as he may desire to attend such hearing, the opportunity to present such evidence and testimony and confront such adverse witnesses as the Licensee desires, and a written statement of the findings of the hearing together with the action taken by the Township Board pursuant to the findings of the hearing.


This Ordinance shall take immediate effect. All Ordinances or parts of Ordinances in conflict herewith are hereby repealed. MEMBERS PRESENT: Byron F. Gallagher, Estella Beardslee, Daryl W. Moss, Robert Gillette, David Gines, James Videto, and Willis Williams.
