Zoning Board of Appeals - 08.26.04

Present: Al Short, Chair; David Herlein , Vice Chair; Beth Kuntzleman , William Jaquays and Bob Roedema

Absent: none

 

Visitors: Ruth Scott, Sally Arnett, Kelly Kidder

 

V04-3 Sally Arnett 7461 McCain Rd. (#000-12-09-201-001-01) for a variance from the front yard setback, requirement 60’, request for a 46’ setback, difference of 14’.

 

Richard J. Renner, Building Administrator, provided the ZBA a written statement describing his version of the discussion between the Arnett’s and the Township office (see Appendix A).

 

Sally Arnett provided the board with her comment about Mr. Renner’s written document plus her contacts with her contractor about the cost of moving the building (see Appendix B).

Al Short discussed the possible alternative of rezoning the properties on McCain between Chapel and Dearing Roads. Beth Kuntzleman moved the request for a variance be denied. Second by Bob Roedema . Vote was unanimous.

 

The reason for turning down the variance was that the applicant could not demonstrate that the special condition and circumstance did not result from the action of the applicant. Section 7.2 Variance Section A, Paragraph 3.
