ZONING BOARD OF APPEALS – SPRING ARBOR TOWNSHIP – MAY 5, 2005

 

Present:   Allan Short, David Herlein, Beth Kuntzleman, Bob Roedema, Bill Jaquays

Absent:   None

 

Visitors:   Melvin Turk, Jr., and Mike Gardynile

 

V05-2   Melvin B. Turk Jr., 8475 Mathews Rd. , (000-12-28-376-002-02) for a variance of 25’ from the side yard setback from the required 30’ and an 18’ rear yard setback from the required 50’.

 

After a presentation by Melvin B. Turk, Jr., on his request for a variance of 25’ for a side yard setback and a rear yard setback of 18’.   The chair asked for participation from the visitor, Mike Gardynile, 28888 N Dr. South, Homer, MI, 49245.   Mr. Gardynile owns land directly south of Melvin B. Turk, Jr.’s property.   Mr. Gardynile stated he wanted the building torn down and that Mr. Turk should honor the variance granted on March 24, 2005 .

 

The Board of Appeals thoroughly questioned the applicant, Melvin B. Turk, Jr., about his admitted mistake of requesting a variance of a rear yard setback of 32’ in the March 24 variance request and the request for 18’ in the April 18, 2005 variance.

 

After a discussion of various alternatives the Board of Appeals proceeded with the following actions.

 

Beth Kuntzleman moved that the Board of Appeals vacate the variance granted on March 24, 2005 for application V05-1, Melvin B. Turk, Jr., 8475 Mathews Rd. , Spring Arbor, MI, 49283; motion seconded by William K. Jaquays.   Roll Call Vote:

              Beth Kuntzleman – yes

              William K. Jaquays – yes

              Bob Roedema – no

              David Herlein – no

              Allan Short – yes

 

Beth Kuntzleman moved to grant variance request V05-2, April 18, 2005, for a side yard setback of 25’ and a rear yard setback of 18’ for an addition to the rear of an existing barn at 8475 Mathews Rd., Spring Arbor, MI, 49283; motion seconded by Bob Roedema.   Roll Call Vote:

              Beth Kuntzleman – yes

              William K. Jaquays – yes

              Bob Roedema – yes

              David Herlein – no

              Allan Short – yes
